Recently, Russell Button, founding attorney of The Button Law Firm, was invited back onto the Law&Crime Sidebar Podcast with host Jesse Weber to discuss a disturbing daycare abuse case out of Lindale, Texas. Surveillance video from Pumpkin Doodles Daycare revealed more than 100 separate incidents of a worker harming toddlers. The case has drawn national attention and raised important questions about childcare safety.

A Pattern of Abuse Caught on Video

During the episode, Jesse Weber reviewed the footage showing the daycare worker repeatedly kicking toddlers, pulling them out of naps by their arms, standing on their hands, and handling them aggressively during diaper changes and rest time. Many of the children were just two years old.

Russell discussed why abuse like this can go unnoticed for so long.

“Most children this age cannot explain what is happening to them. These cases are uncovered when an adult notices something concerning, speaks up, and triggers an investigation.”

In this case, a coworker happened to review the surveillance video and immediately alerted the father of one of the children. The parent then reported the abuse to law enforcement. By the time the footage was reviewed, the abuse had already occurred more than 100 times.

Surveillance Cameras Do Not Prevent Abuse Without Oversight

Although the daycare had cameras installed, the footage had not been regularly reviewed. This is something The Button Law Firm has seen many times in daycare injury investigations.

Russell explained to Jesse:

“If a daycare installs cameras, someone needs to be watching them. Too often, no one checks the footage. Employees quickly learn this and behave as if there is no oversight.”

Texas does not require daycares to monitor their cameras on any schedule. This lack of supervision allowed the abuse to continue for months before it was discovered.

Multiple Safety Systems Failed Inside the Daycare

Russell and Jesse also discussed how several layers of daycare safety responsibilities broke down. Even with background checks and training, a daycare must supervise employees, respond to concerns, and follow mandatory reporting laws.

Under Texas law, daycare workers are mandatory reporters. They must report suspected abuse immediately. However, in this case, it was ultimately a parent who contacted law enforcement after being notified by a staff member.

“This is what we see across the country,” Russell said. “A single bad actor is dangerous, but system failures are what allow the abuse to continue.”

Why the Criminal Case Matters

The daycare worker eventually pleaded guilty to multiple counts of injury to a child and received a 10-year sentence served concurrently. While this conviction provides accountability, it also highlights broader failures in the daycare’s supervision and reporting practices.

Russell noted that criminal cases often play an important role in future civil investigations because they help reveal what safety standards were ignored and where the daycare failed to protect children.
