How Was the North Dallas Daycare Center Operating Unsafely?
In Texas, daycare centers are required to follow childcare laws, also known as the minimum standards, to keep children safe. These laws outline safe hiring practices, such as employing qualified caregivers who have completed specific training and education requirements.
The Dallas daycare center, in this case, failed to follow the standards when it did little to no vetting of the caregiver’s credentials before hiring her. Essentially, the center cared more about having a warm body in the classroom than providing the children, including the little boy, with safe, competent care, a fact that the center’s director admitted.
The minimum standards outline the appropriate actions and discipline methods that caregivers should use when caring with children. This includes closely supervising all children in their care. In this case, that did not happen. In fact, another child in the little boy’s classroom was captured on surveillance video climbing on top of a table without the caregiver noticing.
In addition to causing the little boy’s head injury, the caregiver, later that day, kept him isolated from his classmates by locking him in a bathroom for approximately 45 minutes. (This is not an approved form of discipline per the minimum standards.)
It was later learned that the week prior to this incident, the caregiver separated the little boy from his classmates at lunchtime without giving a reason. Again, isolating a child from classmates for a prolonged amount of time breaks the minimum standards.
The standards also require that daycare directors float between classrooms at a center to ensure that all the children are safe and that the caregivers understand and are complying with the standards. However, that never happened at the North Dallas daycare center.
