A new lawsuit filed by The Button Law Firm alleges that a Frisco daycare center failed to protect a young child after caregivers were captured on surveillance video allegedly shoving, striking, and roughly handling a 3-year-old boy.
A recent Galveston County Daily News feature reports on a lawsuit filed after a 3-year-old boy was allegedly shoved, struck, and roughly handled by caregivers at Kids ‘R’ Kids of Lawler Farm.
The lawsuit, filed on behalf of the child’s family, alleges that staff members repeatedly used excessive force on toddlers while management ignored warning signs and failed to follow Texas childcare safety laws.
Surveillance Footage Allegedly Shows Caregivers Using Force on Toddlers
As detailed in the Galveston County Daily News coverage, the disturbing incidents were uncovered during a Texas Department of Family and Protective Services (DFPS) investigation in June 2024.
That investigation revealed surveillance footage from the daycare classroom showing caregivers allegedly handling toddlers aggressively.
According to the lawsuit, two daycare employees were seen using excessive force on children during separate incidents. In one moment captured on camera, a caregiver allegedly yanked the 3-year-old boy by a single arm and forcefully shoved him into a chair.
The article also states that the child was pushed, struck, and handled roughly by caregivers.
Mother Noticed Injuries and Received No Clear Answers
The child’s mother began noticing troubling signs that something was wrong.
According to the news feature, she saw visible marks on her son’s body, including a dark spot under his eye, and repeatedly asked the daycare what had happened. The complaint states she never received clear answers.
During the state investigation, the child reportedly told DFPS investigators that his teacher hit him and that he felt scared and sad at the daycare.
For many parents, hearing a child say they feel unsafe at daycare is every family’s worst fear.
Galveston County Daily News Highlights Daycare’s Knowledge of Incidents
The Galveston County Daily News report alleges that management at Kids ‘R’ Kids of Lawler Farm was aware of the incidents involving the rough treatment of children.
According to the article, the daycare had received reports of concerning behavior and had access to surveillance footage showing the incidents. Despite this, the lawsuit claims the center failed to properly report the incidents as required under Texas childcare laws.
Instead, the daycare discouraged staff members from reporting the behavior to authorities.
“We know management at Kids ‘R’ Kids of Lawler Farm knew the daycare center was repeatedly breaking Texas childcare laws and endangering children,” said Russell Button of The Button Law Firm. “Instead of reporting the incidents as required by law, the center discouraged staff members from notifying the authorities, breaking additional childcare laws.”
History of Safety Violations Raises Further Concerns
The article also details a troubling history of violations at the daycare.
Following the DFPS investigation, the daycare was cited for six violations of Texas childcare regulations and placed on a safety plan designed to protect children.
The plan restricted certain staff members from supervising children alone without another qualified teacher present. However, according to the lawsuit, the daycare failed to follow those requirements.
The complaint also states that eight additional safety violations were issued between July 2024 and May 2025, raising further concerns about whether the daycare was prioritizing the safety of children in its care.
The Button Law Firm Is Working to Hold the Daycare Accountable
The Button Law Firm filed the lawsuit to seek justice and hold the daycare accountable for the alleged harm to the child and the center’s failure to follow Texas childcare safety laws.
The firm represents families across Texas in cases involving daycare injuries, abuse, and neglect, working to expose unsafe practices and protect children from further harm. As highlighted in the Galveston County Daily News feature, this lawsuit is part of the firm’s broader mission to ensure that daycare centers that violate safety laws are held accountable and that families receive answers when children are harmed.
