Bastrop County, TX – The Button Law Firm has filed a lawsuit on behalf of a mom, Sandra Santos, after her three-year-old daughter suffered a serious injury to her finger at daycare.
What Happened at This Bastrop County Daycare
In March of 2023, a toddler girl in Texas suffered an injury after she climbed on a rolling cart that was left on a playground. Caregivers didn’t intervene and continued to allow her to play on the cart, which was visibly unsafe for a toddler. When the girl fell, she attempted to catch herself and ended up grabbing a sharp point of the metal playground fence, which in turn sliced her finger open. The incident occurred at Grace Lutheran Learning Center in Smithville, Texas.
According to the lawsuit, the little girl required 11 stitches to put her finger back together.

What Went Wrong at This Smithville, TX Daycare?
Caregivers at daycares are responsible for ensuring kids are kept safe. In this case, Grace Lutheran Learning Center’s caregivers failed to prevent injury to this child by ignoring the clearly dangerous activity she was participating in.
Additionally, the directors and owners of the daycare failed to keep the space safe for children, as the metal fence surrounding the outdoor play area had several sharp points sticking out.
After this incident occurred, the state of Texas investigated and found that the daycare center was at fault for the safety violations. The lawsuit even claims that the daycare center had received more than 20 citations from the state for failing to follow safety laws to protect kids from injury.
