How Did the Texas Daycare Center Fail This Little Girl and Her Family?

The minimum standards require daycare centers and their caregivers to provide basic care that includes:

Dehydration can have serious health consequences for children, including dizziness, confusion, and even a decreased amount of blood in their circulatory system.

Third, a daycare center is required to maintain a safe environment for little ones. This is called premises liability. The center should keep the facility clean and well maintained and regularly inspect the center for hazards. In this case, the little girl tripped over a rug in her classroom that caused her to break a bone in her leg. Caregivers and staff at the center should have identified the rug as a safety issue for the classroom and removed it to avoid any fall injuries.

Lastly, whenever a child is injured at a daycare center or even suffers an unsafe experience at a center, the director or caregivers involved in the incident are required to present parents with an incident report. This report provides written documentation about the incident, including what happened to the child, what caregivers were present, and how caregivers attended to the child. However, in this case, several of the little girl’s injuries were not documented by the daycare center’s staff.
