Law enforcement was subsequently called, leading to inquiries at nearby daycares to identify where the child came from. Upon the officer's arrival at Safari Kid Allen, the director was asked about any missing children. Initially, the director assured the officer that all children were present. However, upon further investigation and the presentation of the child, the director then acknowledged the toddler as a student at the daycare.
Expressing her outrage, the child’s mother stated, "I am so angry that Safari Kid Allen did not do their job to watch my son and then had no idea he was missing, even when asked by law enforcement. It is horrifying to think about what would have happened to him if that kind person did not stop and rescue him."
Despite Safari Kid Allen's claims of providing a safe environment, investigations uncovered alarming deficiencies. The facility lacked functioning safety alarms on doors, left the playground unlocked, and neglected to repair a breached fence. Furthermore, records revealed that Safari Kid Allen had incurred 45 citations for violating daycare regulations between September 2019 and November 2023, with 17 citations issued after the incident involving Mattos' son.
Commenting on the matter, Russell Button, the Texas daycare injury attorney who is representing the family in the lawsuit said, "Safari Kid Allen clearly dropped the ball by not closely watching the children in its care, including our client’s son. An innocent toddler’s life was risked when it did not have to be—he could have been hit by a car or even kidnapped. Safari Kid Allen failed this family by not complying with basic safety standards."
