Austin American-Statesman Details Delayed Notification to Parents

The Austin American-Statesman also reported that the father of another 8-month-old girl in the same classroom was not informed of the situation until November 26, 2024 — a whole week after the exposure occurred.

According to the article, the father learned of the issue only when he arrived to pick up his daughter and was told she was being moved to another classroom as a precaution. The Statesman reported that the daycare director implied another child’s exposure may have occurred at home, a claim later contradicted by the investigation.

Classroom Video Shows Multiple Child Care Safety Violations

As detailed by the Austin American-Statesman, classroom video from November 19 showed the caregiver violating multiple Texas child care safety rules.

The Statesman reported that violations included:

  • Leaving infants without supervision
  • Failing to wash hands between diaper changes and meal preparation
  • Improperly handling children, including dropping a child while still on a changing mat

Despite reviewing the video, the article reported that the caregiver was not immediately fired.

Caregiver Admitted to Using THC Vape Pen Inside Daycare Classroom

The Austin American-Statesman reported that when law enforcement interviewed the caregiver again on December 6, 2024, she admitted to smoking a THC vape pen multiple times inside the classroom on November 19.

According to the article, the caregiver told police she brought the vape pen to the daycare two to three times per week and used spray to mask the odor.

State Investigation Finds 24 Violations at Learning Junction Daycare

According to the Austin American-Statesman, the Texas Department of Family and Protective Services completed its investigation and cited Learning Junction Early Education Center for 24 violations of child care safety laws and regulations.

The Statesman reported that the daycare was placed on probation through at least April 28, 2026, with violations including exposing children to dangerous substances and failing to timely notify parents after incidents that placed children at risk.

Why Marijuana Exposure at Daycare Poses Serious Risks to Infants

As quoted by the Austin American-Statesman, The Button Law Firm founder and daycare injury lawyer Russell Button emphasized the long-term risks associated with early THC exposure:

“The children’s brains and nervous systems are still developing, and it’s been proven that early exposure to THC in similar types of vapes carries long-term health risks.”

This case, as reported by the Statesman, highlights how failures in daycare supervision, transparency, and compliance with safety laws can place children in serious danger.

What Parents Should Know About Daycare Safety in Texas

The Austin American-Statesman’s reporting underscores the importance of strict adherence to Texas child care safety laws — and the devastating consequences when daycares fail to protect children in their care.

Parents have the right to expect:

  • Safe, substance-free environments
  • Proper supervision at all times
  • Immediate notification when an incident places a child at risk
