Family Represented by BLFA Deep Betrayal of Parental Trust at The Learning Junction

HUTTO, Texas - At The Button Law Firm, we advocate for families when daycares fail to keep their most fundamental promise to parents: to keep their children safe. Two Texas families came to us after learning that their infants were repeatedly exposed to Delta-9 THC vape smoke inside their classroom at The Learning Junction Early Education Center in Hutto, Texas.

These families chose a licensed childcare center, believing it would provide attentive, nurturing, and safe supervision for their children. Instead, they learned that their babies were forced to inhale marijuana vape fumes while a caregiver, left unsupervised and unmonitored, used a THC Vape Pen only inches away from them.

No parent would ever expect their child to encounter drugs at daycare. Yet that is exactly what happened.

The First Alarming Signs of THC Exposure at Daycare

For months before the truth came to light, both infants frequently came home with red, puffy eyes, nasal congestion, and repeated upper respiratory illnesses. Their parents believed that their children were adjusting to new germs or allergies common in a daycare environment.

Behind the scenes, however, their symptoms aligned with the known effects of exposure to cannabis and THC vape aerosol, especially in infants whose lungs and brains are still developing. Unbeknownst to these families, the real cause was not allergies or normal childhood colds; it was drug exposure inside the classroom.

The Day Everything Changed for These Texas Families

On November 19th, one family noticed their infant was unusually lethargic and unstable at pickup. At home, the baby became increasingly “out of it,” with dilated pupils and difficulty feeding. This prompted an emergency room visit where hospital staff conducted drug testing.

The results were devastating:

The infant tested positive for Carboxy-Delta-9-THC at levels 132 times higher than the threshold for a positive result.

Medical professionals raised concerns about respiratory arrest and early bronchial inflammation. Both parents voluntarily submitted to drug testing to rule out home exposure; each tested negative.

That left only one answer:
The exposure to cannabis happened at The Learning Junction.

How THC Exposure Inside the Classroom Was Confirmed

When the Learning Junction Director first learned of the positive drug test, she did not immediately check the classroom’s camera footage. Instead, she spoke directly to the caregiver, who initially denied ever bringing a THC Vape Pen to work.

Days later, when the daycare finally reviewed the video, it revealed that this caregiver repeatedly retrieved items from her purse and bra, coughed afterward, and used Lysol spray inside the classroom to mask odors. Investigators later confirmed the caregiver had, in fact, been smoking a Delta-9 THC Vape Pen in the classroom multiple times that day and multiple days each week.

The Learning Junction caregiver admitted to storing the vape pen in her accessible purse and bra, smoking it while caring for infants, and dropping it onto the classroom floor several times. The caregiver also admitted she brought the vape pen to work two to three days per week.

Despite this knowledge, the daycare allowed her to continue working with children before law enforcement intervened.

What This Failure Means for Young Children

Infants exposed to THC and vape aerosol face serious risks, including:

  • Impaired neurological development
  • Respiratory problems and airway inflammation
  • Long-term cognitive and behavioral impacts
  • Increased risk of infection due to immune and lung vulnerability

In this case, the infants’ repeated symptoms and the months of unanswered medical visits were consistent with continuous exposure.

These children and their families deserved a safe environment. The Learning Junction failed to provide it.

The Button Law Firm’s Commitment to These Families

We represent these families because what happened was preventable. It resulted directly from The Learning Junction’s failure to supervise employees, enforce drug-free policies, and protect infants from harm. No parent should have to wonder if their child is breathing in dangerous substances while at daycare.

The Button Law Firm will continue to fight for answers, accountability, and systemic change so that no Texas family endures such a betrayal of trust again.
