Unsafe and Prohibited Discipline Captured on Camera
According to the complaint, the incident began with something harmless: a toddler tapping his foot in spilled milk on the classroom floor. Instead of responding with guidance or redirection, the overwhelmed caregiver reacted with prohibited punishment tactics.
Surveillance footage shows the Galaxy Ranch caregiver abruptly grabbing the little boy by the arm, dragging him across the classroom, and forcing him into a time-out chair placed in a blind spot of the camera. The caregiver later admitted that the child’s head struck an open bathroom door during this drag across the room.
Our lawsuit states that the Galaxy Ranch employee failed to comfort the child or check for injuries. Instead, the caregiver ignored his cries and pleas to go home and continued preparing the room for naptime. When the child lay crying on his cot, surveillance footage shows the caregiver repeatedly covering his head with a blanket, another clear violation of childcare safety standards.
Medical Distress Ignored for Nearly an Hour
When the Galaxy Ranch caregiver attempted to force the child’s eyes shut, she discovered the toddler was no longer responsive.
By this point, the little boy had vomited, become limp, and appeared to show signs consistent with seizure activity. Yet nearly an hour passed from the moment his head hit the bathroom door before the daycare finally called 911.
When first responders arrived, they found the toddler unconscious, struggling to breathe, and experiencing multiple seizures. Emergency personnel had to manually assist his breathing before transporting him to a nearby hospital.
A CT scan revealed the devastating truth: the toddler had a skull fracture and brain bleed. Given the severity of his condition, he required an emergency airlift to a Dallas acute-care hospital, where he spent days in the pediatric intensive care unit.
Parents Left Traumatized and Searching for Answers
For his parents, the trauma was overwhelming. “Galaxy Ranch had us experience a nightmare we can’t wake up from,” his mother, Keisha, said. “Watching our son lie in that hospital bed, hooked up to machines, fighting to stay alive, is something I will never forget. We trusted them, and our family will have to deal with the consequences of that broken trust every day.”
Undertrained Staff and Ignored Complaints
The Saunders family selected Galaxy Ranch Private School because the daycare advertised experienced staff, a safe environment, and constant surveillance. Instead, the caregiver responsible for their son had only been employed there for three months and was left alone to supervise 10 toddlers - an arrangement that was both overwhelming and unsafe.
The school had also received at least one prior complaint about this caregiver, yet failed to document it, provide corrective training, or evaluate whether she was fit for the position.
State Investigations Confirm the Violations
Following the incident, investigations by the Texas Health and Human Services Commission and the Texas Department of Family and Protective Services substantiated the allegations. Both agencies cited Galaxy Ranch Private School for using prohibited punishment and failing to ensure that no child is abused, neglected, or exploited.
“These facts are deeply troubling,” says Russell Button, founding attorney of The Button Law Firm and counsel for the Saunders family. “A little boy’s life will never be the same because a daycare decided to leave an overwhelmed and unfit daycare employee on her own in a classroom at maximum capacity. Nothing about this was an accident. This was a preventable chain of dangerous choices that violated the minimum standards of childcare.”
He continues: “Our lawsuit is about accountability. It’s about ensuring no other Texas child is ever put in this situation again. Daycares must follow the law. When they don’t, and a child is harmed, we will step in to protect families and fight for change.”
