Two Williamson County families are seeking justice after learning their babies were exposed to THC vape smoke inside the infant classroom at The Learning Junction Early Education Center in Hutto. The Button Law Firm filed a lawsuit after investigators confirmed that a caregiver had been vaping Delta 9 THC around the family’s infant daughters over a period of months. CBS Austin recently featured the case, bringing further attention to what happened.

How the Families Discovered the Drug Exposure

According to CBS Austin, the truth began to surface on November 19, 2024, when one mother rushed her daughter to the emergency room because her baby was unusually lethargic and unsteady. Hospital testing revealed that the infant had THC in her system at a level far above the amount needed for a positive result. Both parents tested negative for drug exposure, which ruled out the possibility that the THC came from home. The only remaining location was the daycare.

Before this emergency, both infants had been experiencing red eyes, congestion, and frequent respiratory symptoms. Their parents believed these issues were typical illnesses children contract in daycare settings. Once the exposure was revealed, the symptoms made sense.

What Investigators Found Inside the Hutto Daycare Classroom

As the article explains, classroom video footage reviewed during the investigation showed the caregiver taking items from her purse or bra and vaping inside the infant room. She then sprayed Lysol in the air, which investigators believe was an attempt to cover the smell. The caregiver later admitted that she brought her THC vape pen to work two or three days a week and used it multiple times a day while caring for the babies.

Even after the daycare became aware of concerns about her behavior, she was not removed from working with children. Instead, she continued caring for kids and was later placed in a class with three-year-olds. She ultimately resigned during the investigation but was never terminated.

A Texas Daycare With a Troubling Compliance History

State investigators found additional issues at The Learning Junction. The Texas Department of Family and Protective Services cited the center for 24 violations, and its license was placed on probation for a period of at least one year. According to the article by CBS Austin, records shared by the Texas Department of Health and Human Services show citations around the time of this incident that were labeled non-compliant and as posing a greater risk to children’s health and safety. These findings highlight the daycare’s ongoing struggle to meet basic safety standards.

The Button Law Firm’s Commitment to These Families

Attorney Russell Button explained in his interview with CBS Austin that this case is one of the most shocking childcare failures The Button Law Firm has handled. These parents trusted a licensed daycare with their infants, and that trust was broken in a way no parent should ever experience. The families want accountability and honest answers about how their babies were exposed to THC vape smoke and why a caregiver who admitted to vaping on the job was allowed to continue working with children.

The Button Law Firm is committed to helping these families understand exactly what went wrong and making sure the daycare takes responsibility for its failures. We are also focused on raising awareness so that other childcare centers take safety more seriously. Cases like this not only help the families involved but also help push for stronger protections for children across Texas.
