Allegations Focus on Repeated THC Vape Use Inside Infant Classroom

Fox San Antonio reported that the lawsuit alleges a caregiver repeatedly vaped Delta-9 THC inside the infant classroom while caring for babies as young as eight months old.

According to the complaint, the caregiver later admitted to investigators that she brought a THC vape pen to the daycare two to three days per week and used it multiple times daily while on the job.

Surveillance Video and Law Enforcement Review Cited in Lawsuit

According to Fox San Antonio, Ring camera footage reviewed by law enforcement allegedly shows the caregiver retrieving a vape pen from her purse or clothing, vaping inside the classroom, and spraying Lysol to conceal the smell before continuing to care for infants

The lawsuit states the caregiver was not immediately removed from the classroom and continued working with children until she voluntarily left following a law enforcement interview.

State Agencies Identify Pattern of Safety Failures

Fox San Antonio reported that the Texas Department of Family and Protective Services cited The Learning Junction Early Education Center for 24 violations of child care safety laws and placed the daycare’s license on probation for at least one year.

The outlet also reported that the Texas Department of Health and Human Services released inspection records showing citations labeled “non-compliant” and presenting a “greater risk to the health and safety of children.”
