A Moment Without Supervision That Changed Everything

As detailed in the Law&Crime article, the toddler was in the care of a home-based daycare provider who was responsible for watching more than a dozen children at the time.

During that time, the child was allowed to wander outside unsupervised into a backyard area where a livestock water trough was present. He fell into the trough and drowned.

Law enforcement later determined the provider’s actions were carried out with criminal negligence.

This was not a situation that required complex safety planning. It required basic supervision. At 20 months old, a child depends entirely on the adult responsible for them to prevent access to known hazards.

When Basic Child Safety Rules Are Ignored at Daycares

Law&Crime’s reporting makes clear that several fundamental child safety principles were not followed.

The provider was caring for 14 children, far exceeding what is allowed under Oregon law for an unlicensed daycare. That number alone created an environment where adequate supervision was not possible.

At the same time, a water hazard remained accessible in an area where young children could move freely. These are not minor oversights. They are conditions that create obvious and serious risk.

As Russell Button explained in statements referenced by Law&Crime, this situation reflects a failure of basic childcare responsibilities. When someone agrees to care for children, they must control the environment and maintain constant supervision—especially around known dangers.

A Setting That Never Should Have Been Allowed

According to Law&Crime, the daycare operator did not have the proper license to care for the number of children present. After the incident, all children were removed from the home once authorities discovered the extent of the violations.

The operator has since been indicted on multiple charges, including manslaughter and criminally negligent homicide, and the case remains under investigation by Oregon’s Department of Early Learning and Care.

This situation raises a larger issue: regulations exist for a reason. Limits on the number of children, supervision requirements, and child safety standards are designed to prevent this kind of tragedy.

The Button Law Firm Handles Child Wrongful Death Cases

As reflected in Law&Crime’s coverage, this case centers on a failure to follow the most basic rules of child safety—leaving a toddler unattended, allowing access to a drowning hazard, and taking on more children than could be safely supervised.

Accountability is about confronting those failures and making sure they are not repeated.

The Button Law Firm has handled previous wrongful death cases where supervision was ignored, child safety standards were violated, and ultimately, the child is the one who suffers. To see how we’ve helped other families after the wrongful death of a child, click here.
