A Delayed Emergency With Lasting Consequences
According to the lawsuit, emergency medical services were not called until nearly an hour after the head injury occurred. When first responders arrived, they assisted the child’s breathing before transporting him to a hospital.
Medical imaging revealed a fractured skull, internal bleeding in the brain, and a traumatic brain injury. Due to the severity of his condition, the child was transferred by helicopter to a Dallas hospital, where he spent several days in the pediatric intensive care unit.
For Keisha Saunders, those moments are impossible to forget.
“Galaxy Ranch Private School had us experience a nightmare we can’t wake up from,” she said. “Watching our son lie in that hospital bed, hooked up to machines, fighting to stay alive, is something I will never forget. We trusted Galaxy Ranch Private School and our family will have to deal with the consequences of that broken trust every day.”
Concerns About Discipline, Staffing, and Supervision
The lawsuit also highlights broader concerns about how the classroom was staffed and supervised. According to the filing, the overwhelmed caregiver had been employed at the school for only a few months and was responsible for supervising a classroom operating at maximum capacity without additional assistance.
The lawsuit states that prior concerns about the caregiver were not formally documented or addressed.
State regulators investigated the incident. According to the lawsuit, the Texas Health and Human Services Commission substantiated allegations of abuse and cited the school for multiple violations of state childcare regulations, including the use of prohibited disciplinary methods.
How The Button Law Firm Is Supporting the Saunders Family
The Button Law Firm represents the Saunders family as they seek answers about how a moment of discipline escalated into a life-threatening injury. Our focus is on examining what happened inside the classroom, how supervision and staffing decisions were made, and whether safety standards meant to protect young children were followed.
As daycare and child injury attorney Russell Button stated in the Herald Banner coverage, what happened was not an accident. It was a preventable chain of decisions that placed a child at risk.
For the Saunders family, bringing this lawsuit forward is about accountability and protecting other children. For our firm, it is about ensuring that childcare providers are held to the standards families trust them to meet.
