Ignored Warnings and Missed Opportunities to Prevent Sexual Abuse

The Facts reports that in March 2022, parents of another young child informed Lionheart management that Davidson had inappropriately touched children in his classroom. Despite this serious report, he remained employed, and no notifications were made to the Texas Department of Family and Protective Services or local authorities.

A July 2022 email from a teacher to the center’s director described further inappropriate conduct, including touching under clothing and taking photos of children in the restroom. Even with multiple written complaints, the leadership team at Lionheart failed to alert authorities or remove Davidson from contact with children.

Investigations by state agencies later confirmed multiple violations, including the failure to report suspected abuse and inadequate supervision of caregivers. At least two separate staff members reportedly witnessed questionable behavior and did not report it, illustrating the systemic neglect of leadership responsibilities.

How The Button Law Firm Is Holding Lionheart Accountable

The lawsuit filed by The Button Law Firm aims to hold the daycare’s leadership responsible for the preventable harm that occurred. “This lawsuit is about accountability and prevention,” says The Button Law Firm daycare injury lawyer Russell Button. “Daycare laws exist to protect children, and when leadership ignores warnings, every child in the facility is put at risk. Our goal is to ensure that Lionheart and other daycare centers cannot sidestep their responsibilities.”

The teacher in question was arrested and pled guilty to a second-degree felony for indecency with a child by sexual contact. The lawsuit emphasizes that daycare management failures allowed this abuse to continue unchecked, placing children in danger for an extended period.
