What happens when the daycare that was caring for your infant failed to keep them safe? If your infant was the victim of a catastrophic injury at daycare, be sure to follow these steps.

First, seek medical attention immediately. Serious injuries, like traumatic brain injuries, spinal cord injuries, and broken bones, need to be treated right away. Many of the most severe injuries can’t be seen – and the younger the child is, the less likely it is that they can tell you what’s wrong.

Once your child has received medical attention, notify the proper authorities. First, you’ll want to report the incident and injuries to the state childcare licensing division. The state will conduct an independent investigation to see if any violations of the minimum standards caused the injuries to your child. The state investigation can lead to the enforcement of corrective measures to make sure this doesn’t happen to another child in their care.

If you believe there was any criminal intent, then the second authority you need to call is the police. The police will conduct their own investigation related to criminal charges, and that’s separate from the daycare licensing investigation.
