Baby CryingIn spring 2024, a caregiver charged with looking after the infants at a daycare center in the Galveston area heard an unsettling loud noise. It was the sound of another caregiver hitting an infant on the side of his head. The caregiver immediately reported the incident to the daycare center's director, who then reported it to the parents.

When confronted about the incident, the accused caregiver attempted to minimize her abusive actions by insisting the infant initiated the confrontation. Sadly, this was not the first time that this caregiver acted aggressively toward a child or used inappropriate discipline methods at the center, yet the center continued to employ the troubled caregiver.

Upset that the Galveston-area daycare center endangered their son, the infant’s parents turned to our experienced Texas daycare injury lawyers at The Button Law Firm for help and answers. Our legal team got justice for the family by holding the daycare center accountable for harming the infant, including exposing its numerous safety failures that put the innocent child in harm’s way.

How Did the Galveston-Area Daycare Center Endanger This Infant’s Life?

All licensed daycare centers in Texas are required to follow the state’s mandated minimum standards. These childcare laws are meant to protect children, like the infant in this case, from being harmed at daycare centers.

However, a thorough investigation into this incident conducted by the Texas Department of Family and Protective Services found that the Galveston-area daycare center ignored the minimum standards and acted negligently (meaning it breached its duty to keep the infant safe under its watch) when it:

  • Did not immediately terminate caregivers who were physically abusive toward children at the center
  • Enabled caregivers to use unapproved discipline methods on children, including corporal punishment or threats of corporal punishment. (Caregivers are required to use positive tactics that are appropriate to a child’s level of understanding.)
  • Failed to supervise its caregivers throughout the day to ensure they followed the minimum standards
  • Hired unqualified and untrained caregivers. (All caregivers are required to demonstrate good judgment and self-control in the presence of children.)
  • Neglected to complete incident reports and file reports with the state that detail the serious injuries children suffered at the center

Sadly, the incident involving the infant at this daycare center was not isolated. The center had 18 citations from the state, highlighting a pattern of unsafe practices that harmed the children in its care. In fact, just a month after this infant suffered injuries caused by the abusive caregiver, the center received four additional citations for incidents that occurred between May and September.

How Did The Button Law Firm Help This Galveston-Area Family Move Forward?

The infant in this case was seriously injured when his caregiver at the Galveston-area daycare center hit him on the side of his head with such force that it left a red mark. The child was examined and treated at a nearby hospital for his injuries because head injuries, especially in infants who have soft crowns that are still developing, can be severe and lead to skull fractures and brain injuries.

Unfortunately, the boy also suffered significant emotional damages, which greatly disrupted his daily life and routine, as a result of the Galveston-area daycare center’s negligence. Once a happy baby, he became fearful, anxious, and clingy. His behavior even began to mimic that of his abusive caregiver, becoming aggressive toward family members, friends, and strangers, and his behavior indicates that he is no longer happy, according to his parents.

The child also began regressing in his developmental milestones after being injured at the daycare center. To comfort himself, he started using a pacifier at night. He also developed night terrors that required his parents’ attention to help him fall back asleep.

Thankfully, our experienced and compassionate daycare injury lawyers were able to get the justice that the infant and his family needed to move forward. We secured a life-changing result to compensate the family for the boy’s medical expenses and long-term behavioral therapy sessions that help erase the negative effects of the trauma that he endured at the Galveston-area daycare center.
