A Texas mother dropped her young son off at her gym’s daycare center, offered to gym members so they can work out with the peace of mind their children will be safe. While in the center’s care, the young boy was able to climb on top of a table, then fell and hit his head on the ground.
The child suffered a deep laceration, yet the gym’s daycare workers did not notify his mother until she arrived to pick him up at the end of her workout. It turns out that the gym did not have any clear safety or supervision guidelines in place for its childcare center.
As soon as our Texas daycare injury lawyers at The Button Law Firm got involved, we fought to hold the gym accountable for its numerous childcare safety failures that led to the boy’s injuries. The work of our dedicated team helped the boy and his mother move forward.
How Could the Gym Have Prevented the Little Boy’s Injuries?
In Texas, all daycare centers, including those operating inside gyms and health clubs, are required to follow state childcare laws, also known as minimum standards. The standards cover every aspect of childcare, including proper supervision requirements, such as mandated child-to-caregiver ratios, that ensure children are being watched closely.
In this case, the gym had no safety or supervision protocols in place. Because of this, caregivers were not closely watching the young boy. (The minimum standards require caregivers to have close visual and auditory proximity to each child under their watch.) Not a single caregiver saw the boy climb on top of the table or intervened to prevent him from falling.
In addition, the gym was operating the daycare without having enough employees on staff to monitor the children in the room properly. This shortage also meant older children were in the same space as younger children, including those in the designated area for infants at the gym’s daycare center, violating another minimum standard to keep children safe. The standards require daycare classrooms to meet a child’s developmental needs and milestones by keeping older children and infants in separate rooms. By allowing the intermingling of ages, little ones were at risk of being injured by older, bigger, and more active children.
Lastly, the caregivers at the gym daycare were not properly trained in how to respond to emergency situations. Parents should be immediately notified if their child is injured or endangered in any way, and caregivers should know when to seek out emergency medical services. The young boy fell on his head and sustained a deep laceration. Head injuries are very serious, as they can involve skull fractures or brain injuries that cause long-term issues with a child’s development and quality of life, so 911 should have been called immediately. The caregivers in this case not only didn’t call 911, but they also waited until the boy’s mother completed her workout to alert her about the injuries that her son sustained while in their care, losing valuable time and leaving the child in pain.
How Did The Button Law Firm Help This Boy and His Family Move Forward?
Thankfully, the gym daycare center used surveillance cameras, which caught the incident. The young boy’s fall off the table caused him to hit his head on the floor and suffer a cut so deep that it left a scar.
As mentioned above, caregivers at the gym daycare left the boy to suffer until his mother was done with her workout. They did not seek any medical attention in the meantime.
The cut was so deep that doctors had to use stitches to close the wound. Due to the severity of the injury, laser treatment—often used to promote healing and reduce scarring—was not a viable option.
Our experienced daycare injury lawyers helped the boy and his mother get justice and hold the gym accountable for its neglectful operations and the multiple safety failures that caused his injuries. Our legal team secured a life-changing result for the boy and his mother for his costly medical bills, permanent scarring, and traumatic experience to help them heal and move forward.
