The incidents, discovered in 2022, revealed the caregiver hit the 3-year-old girl with objects, threatened her, and yelled at her as a form of punishment, all actions that break Texas childcare laws.

It was later discovered that the daycare center operated the toddlers’ classroom “out of ratio,” meaning the number of children in a classroom exceeded the recommended amount for the age group, per the state’s minimum standards. In this case, the center assigned 15 toddlers to a single caregiver and did not provide the caregiver with any training on how to properly care for and discipline the children. The daycare center also chose to withhold additional support for the caregiver following her complaints to the center’s director.

How Did This Texas Daycare Center Fail a Toddler and Her Mom? 

In Texas, daycare centers are required to comply with a strict set of laws, also known as minimum standards. The laws outline how daycare centers should operate and what safety practices daycares should follow to keep little ones safe. In this case, the Texas daycare center ignored several minimum standards, which resulted in a toddler suffering at the hands of her caregiver.

First, the state mandates child-to-caregiver ratios to ensure little ones are properly supervised throughout the day. The daycare center in this case did not do that. The toddler’s classroom had too many children assigned to the single caregiver, leading to the caregiver feeling overwhelmed and taking it out on the toddler by inappropriately disciplining and injuring her.  The caregiver also told state investigators she did not get any additional support from the director when she complained about the number of children she had to supervise.

Secondly, the daycare center had already breached its duty to keep the children at the center safe when it hired an unqualified caregiver. The caregiver responsible for the toddler in this case did not have a degree or any certification in childcare, which is required by Texas childcare laws. In addition, the daycare center did not provide the caregiver with formal training or education on following the minimum standards, including the proper and age-appropriate discipline tactics a caregiver should use if children, including toddlers, acted out.

Lastly, an independent investigation into the incident conducted by the Texas Health and Human Services Commission Child-Care Licensing Division and the Texas Department of Family and Protective Services concluded that the center failed the children. The investigation led to the center being cited for three violations of the minimum standards: using prohibited punishment tactics, including the caregiver hitting the toddler with an object; threatening corporal punishment; and yelling at the toddler.
