Child Crying While PlayingJustice for Infant Injured by Caregiver's Rough Handling at Killeen Daycare

A 10-month-old girl suffered a fractured arm after being aggressively handled by a caregiver at a Killeen daycare. What made the incident even more troubling was what happened afterward. Instead of immediately telling the child's parents how she was injured, the daycare provided multiple explanations before the truth was finally uncovered.

At The Button Law Firm, our experienced daycare and child injury lawyers have seen how devastating these situations can be for families. Once the parents learned what happened to their daughter, they turned to our team for answers, accountability, and help moving forward.

How Did This 10-Month-Old Suffer a Broken Arm at Daycare?

On June 13, 2023, the infant was attending Just for Tots in Killeen, Texas.

According to video footage, the little girl was sitting on the floor playing with other children when a caregiver abruptly grabbed her by one arm and pulled her away from the group. The caregiver then dropped her onto another area of the classroom floor.

The baby immediately cried out in pain.

At only 10 months old, crawling was the only way she knew how to move around independently. As she attempted to crawl, her injured arm repeatedly gave out beneath her. The video showed her struggling to move while crying and seeking comfort from the adults around her.

Despite these obvious signs of distress, the caregiver walked past the child and failed to provide assistance or seek medical attention.

Later that afternoon, the daycare contacted the child's parents and told them their daughter was being unusually fussy.

But when her parents arrived, they immediately knew something was wrong.

Their daughter was crying inconsolably and would not move her arm.

Concerned for her well-being, they took her for medical treatment, where doctors discovered she had suffered a torus fracture near her elbow. As a result of the injury, she required a cast on her arm while the fracture healed.

How Did Just for Tots Fail This Family?

When parents place their children in daycare, they trust that caregivers will treat them with patience, good judgment, and appropriate care.

That did not happen here.

Texas childcare laws require caregivers to demonstrate competency, good judgment, and self-control while caring for children. A state investigation later substantiated the allegations involving this infant and cited Just for Tots for violating those requirements.

The family's concerns grew even further as they tried to learn how their daughter had been injured.

Initially, the daycare suggested another child had caused the injury. Later, the family was told their daughter somehow injured herself. The daycare also provided a shortened video clip that showed only the aftermath of the incident rather than the event that caused the injury.

It was not until the parents continued asking questions and pushed for additional information that they learned what had actually happened to their daughter.

The state investigation was not the first time Just for Tots had faced scrutiny. Records showed a history of deficiencies involving caregiver training, reporting requirements, supervision concerns, and other violations of Texas childcare laws designed to protect children.

What happened to this little girl was preventable.
