LEWISVILLE, TEXAS – A two-year-old child was seriously injured at The Learning Experience daycare in Lewisville after slipping on a wet floor that staff knew was dangerous. The toddler hit the ground face-first, causing a serious mouth injury that left her with heavy bleeding for hours. She was left in pain, frightened, and without the immediate medical care she clearly needed. The injury was so severe that the toddler’s tooth had to be extracted. The Button Law Firm is representing the family in their fight for answers and accountability.

A Slip, a Fall, and a Child Left Bleeding
Heavy rain caused water to leak into the daycare facility that morning. Despite this, the staff allowed children to walk through the wet, slick area with no warnings or barriers in place. The toddler fell face-first onto the hard floor, initially chipping a tooth on impact and sustaining injuries that caused significant bleeding. Her dress and face were soaked in blood, and the bleeding continued for hours.
The daycare did not call 911. Instead, daycare staff downplayed the severity of her injuries when speaking with her parents, telling them that she was fine and did not need to be picked up early. As a result, she did not receive appropriate medical attention until hours later. Ultimately, the severity of the mouth injury led to a necessary extraction of a front tooth and the discoloration of another.
Daycare Knew the Risk and Failed to Act
The Learning Experience had delayed its opening that day due to the storm. Staff were fully aware that water was leaking into the building and pooling near the playground doors. Still, no steps were taken to ensure the floor was cleaned up properly and the children were kept away from the hazardous area. According to the state’s investigation, the facility had ample opportunity to prevent what happened and chose inaction.
State Cites Daycare for Violations
Following the incident, the Texas Health and Human Services Child Care Licensing Division investigated and issued citations to The Learning Experience for failing to maintain the building in a way that protected children’s health and safety and failing to demonstrate good judgment and self-control in the presence of children.
These were not the daycare’s first violations. In a previous inspection, the facility had been cited for failing to ensure that all staff and the director held the required training and certification in pediatric first aid and CPR. This ongoing failure to meet basic safety standards points to a larger pattern of failure.
Preventable Harm That Should Never Have Happened
This child’s injuries were caused by a known safety hazard that was ignored. The daycare had every opportunity to act but chose not to. As a result, a young child endured a painful, frightening experience in a place where she was supposed to be safe.
Daycares are trusted to protect the most vulnerable members of our communities. When that trust is broken, the consequences can be devastating. No child should suffer preventable harm in a space designed to care for them.
