EL PASO, TEXAS - KFOX14/CBS4 has featured a story of a Button Law Firm client and her child after the child suffered a serious injury in April of 2023.
What Happened at This El Paso Daycare?
According to the complaint filed against the daycare, the 7-year-old child, who was left unsupervised, went to reach for his backpack, when the daycare’s large locker fell on him, leading to serious injuries – the locker's impact was so great that it broke a nearby table. This incident resulted in the child suffering a severe concussion and a contusion to the left elbow, underscoring the need for a closer examination of childcare safety protocols. After the incident, the family is seeking answers and accountability from the daycare.
Russell Button, attorney for the affected family, highlighted the gravity of the situation in an interview with CBS4. "The weight of the locker required two adults to be able to lift it up off of there to get the child out, and as a result, obviously our client's child had a severe head injury, among other psychological trauma injuries."

How The Button Law Firm is Working to Get Justice for This El Paso, Texas Family
The lawsuit filed by The Button Law Firm aims to hold Mini Me’s Child Center accountable and to serve as a cautionary tale for other childcare facilities. Attorney Button emphasized the lapses in safety protocols, stating, "They didn't follow manufacturer's instructions. They didn't have proper anchoring equipment, and they didn't have proper supervision of the child to go get the backpack."
The objective of the lawsuit is outlined by Button: "Our goal with the lawsuit is twofold. One is to hold other daycares or this daycare accountable to make sure that it doesn't happen again and put others on notice that they need to cross their t's and dot their I's to keep the kids safe."
Growing Concern Amongst Parents in El Paso
According to the article, the incident has sparked concerns among local parents, leading to increased wariness about entrusting their children to childcare facilities. In the CBS4 article, Erika Luna, a mother of three, expressed the sentiment shared by many parents, stating, "All of us moms, we think, we know that nobody’s gonna take care of your kids better than we do."
Russell Button, drawing attention to the daycare's history, recommended parents thoroughly research potential facilities. He urged parents to check publicly listed complaints and company history, including any name changes aimed at evading negative publicity, through Texas Health and Human Services’ licensing division. Additionally, he recommends parents conduct comprehensive tours of childcare centers before making a decision.
