The Medical Emergency That Changed Everything
KXAN reported that on November 19, 2024, one mother noticed her 9-month-old daughter was unusually lethargic and unsteady after being picked up from daycare. She rushed her baby to the emergency room, where testing revealed THC in the child’s system at a level 132 times above the minimum threshold for a positive result, according to the lawsuit.
Before that day, both infants had suffered from bloodshot eyes, repeated upper respiratory illnesses, and severe ear infections. Their parents believed these were typical illnesses until the hospital testing revealed a much more serious cause.
Daycare Leadership Failed to Act, Lawsuit Alleges
Despite knowing about the allegations and reviewing surveillance footage from that day, the article states that the director and owner of The Learning Junction failed to intervene, failed to report the behavior, and failed to notify parents as required by Texas law. The caregiver was not immediately fired and was allowed to continue working with children.

Following the investigation, the Texas Department of Family and Protective Services cited The Learning Junction Early Education Center for 24 safety violations. These included failing to maintain a drug-free environment, failing to protect infants from abuse or neglect, improper supervision, unsafe sleep practices, and unsanitary food and diaper-changing conditions.
Due to the extensive pattern of violations, the daycare’s license was placed on a one-year probation, according to state records referenced in the lawsuit and reported by KXAN.
