In July 2021, an unqualified and untrained worker at a daycare in Irving, Texas was frustrated and inappropriately grabbed the arm of a little boy on two separate occasions. The daycare’s security footage captured the worker grabbing the boy by the arm, slamming him into a chair, then forcefully pushing the chair into a table. Later, the worker grabbed the boy’s arm to redirect him to a wall with other children. 

The worker scratched the boy’s arm, breaking the skin and leaving him with deep, red, and inflamed marks.

The daycare advertised itself as having values such as employing “positive behavior experts” who lead by example, among other traits that parents find comforting. However, the facility failed to ensure its caregivers were qualified to properly take care of children, including knowing basic measures to keep children safe or techniques to discipline them appropriately.

Disregard for Minimum Care Guidelines in Texas

In Texas, daycare centers are required to follow strict minimum care guidelines to protect the children under their care. In this case, the daycare disregarded these standards, thus violating the law and not meeting the parents’ expectations by failing to:

  • Have workers demonstrate competency, good judgment, and self-control
  • Practice positive methods of discipline and guidance
  • Ensure that no child is abused, neglected, or exploited
  • Train their staff on how to appropriately discipline, handle, and care for children
  • Immediately notify parents of any situation that placed their child at risk
  • Report all incidents involving serious injury to children and/or situation that place a child at risk to the Department of Family and Protective Services

Two days after the incident that harmed the little boy, the daycare facility was cited by the Texas Department of Family and Protective Services for not meeting the above criteria in addition to having class sizes significantly over the state mandated child-to-caregiver ratios.
