What the State Investigation Revealed

In early July 2024, Kylee Wieland received a call from an investigator with the Texas Department of Family and Protective Services (DFPS). The agency had received a report regarding concerning treatment of children in the three-year-old classroom at Kids ‘R’ Kids.

The investigation uncovered video footage from a month prior, showing a pattern of rough and aggressive physical handling by caregivers. Children were pulled, yanked, shoved, and struck.

On June 5, 2024, footage captured a caregiver yanking the three-year-old child by his arm and forcefully pushing him into a chair.

When interviewed, the child reported that his teacher had hit him and that he felt scared and sad at daycare. His mother had previously noticed unexplained marks, including a dark spot under his eye, along with behavioral changes. She had raised concerns with the daycare, but was not informed of what was occurring in the classroom.

Instead, she learned of the conduct from the state.

What Kids ‘R’ Kids Allegedly Knew

The lawsuit alleges that Kids ‘R’ Kids was aware of concerns before DFPS became involved.

Management had reviewed video footage. Reports of rough handling had been made internally. Employees had received warnings.

Despite this, parents were not notified, and the conduct was not reported to state licensing authorities as required under Texas mandatory reporting laws.

The lawsuit further alleges significant failures in leadership and oversight. Staff reported being discouraged from contacting state licensing officials.

Hiring decisions allegedly prioritized willingness to accept low pay over qualifications and temperament.

The facility’s owner reportedly lacked understanding of licensing requirements and rarely visited the location despite known safety concerns.

According to the lawsuit, these failures reflect a broader breakdown in supervision and accountability.

Holding Frisco Daycares Accountable for Negligence

What happened to this child was preventable.

The lawsuit claims Kids ‘R’ Kids negligently operated its facility, failed to properly hire and supervise caregivers, failed to follow state safety standards, and failed to comply with mandatory reporting requirements.

Daycare operators have a legal duty to protect the children entrusted to their care. When warning signs are ignored and reporting obligations are not followed, children are placed at risk.
