PLANO, TX – The Dallas-based personal injury lawyers at The Button Law Firm have filed a lawsuit on behalf of five North Texas Families against a Plano daycare called Children’s Learning Adventure of Willow Bend. The lawsuit comes after the families claimed the daycare violated multiple licensing laws, including using inappropriate discipline against the children in their care.
The exact incidents of improper discipline include:
- “Popping” 3- and 4-year-old children on the buttocks with a wooden spoon
- Using threatening language against the group of 15 toddlers
- Using fear and intimidation tactics when the toddlers misbehaved
The complaint filed on behalf of the families involved in the lawsuit states that the Children’s Learning Adventure Childcare Center – Willow Bend director and other employees at the daycare reported hearing the teacher screaming at children from other parts of the daycare but did nothing to help them.
It wasn’t until a four-year-old told his mother about the abuse in March of 2022 that other families discovered that their children were also victims.
The teacher, Tonya Rush, had no childcare certification or formal training from the facility, even though she was the single caregiver for the large group of toddlers. Rush continuously failed to properly redirect children who were misbehaving, often becoming overwhelmed and seeking help to control the children in her classroom.
According to the suit, Rush’s requests for help were met with laughs by the other caregivers. The caregiver was struggling with her mental health – having sought religious advisers and calling help hotlines during her lunch break while working at Children’s Learning Adventure in Plano.
The daycare injury attorney representing the families, Russell Button, commented, “Children’s Learning Adventure Child Care Center acted in the interest of profits over the well-being of a classroom of toddlers. But more importantly, the daycare center did not take enough action in removing the caregiver, who was clearly unprepared and unfit for the job.”
After investigating independently, the state of Texas was able to substantiate the complaints from the parents.
