Law&Crime Covers BLF Lawsuit After 4-Year-Old Was Forced Into Daycare “Fight Club”

Law&Crime is reporting on a lawsuit filed by The Button Law Firm on behalf of the Harris family after their 4-year-old son was forced to defend himself from another child while a daycare teacher encouraged the fight and physically harmed him.

The lawsuit against Arka Montessori Academy of Risinger details surveillance footage showing a teacher grabbing, shaking, dragging, and throwing the child to the floor while another employee watched and failed to intervene. “Arka Montessori treated 4-year-old U.H. like a human ragdoll,” the lawsuit states. “He was forced to physically defend himself from both a child and an adult 10 times his size.”

A Daycare Teacher Encouraged Her Own Child to Keep Fighting

The Harris family’s son had been moved into another classroom near the end of the day after his regular teacher’s shift ended. While the supervising teacher had her back turned, another child walked up and hit the 4-year-old in the back, causing a fight to break out.

The other child’s mother, who was also working as an Arka Montessori teacher, later entered the classroom. Instead of calming the situation, she encouraged her own son to continue the confrontation. Another teacher later reported that she heard the caregiver telling her son to kick the Harris boy and trying to force him to hit the 4-year-old.

The teacher then grabbed the Harris’s son, pulled him closer, and held onto him as he tried to escape. She yanked his leg out from underneath him while still holding his wrist, sending him crashing onto the floor. Another Arka Montessori employee watched what was happening and did nothing to intervene, leaving a 4-year-old trying to protect himself while the adults responsible for his safety either contributed to the harm or stood by and allowed it to happen.

The Physical Injuries Were Only the Beginning

The Harris family’s son was left with bruises and scratches, post-traumatic headaches, and pain after the incident. But Law&Crime’s coverage also highlighted what happened after those physical injuries began to heal.

The child became anxious and afraid to be left alone. He began needing constant reassurance from his parents and experienced sudden, intense emotional outbursts. The Harris family immediately removed him from Arka Montessori, but moving him to another daycare did not erase the fear created by what happened.

The lawsuit describes moments when the child would freeze at the classroom doorway, refuse to go inside, cry, and cling to his parents because he was so afraid of returning to a daycare environment. Eventually, the family made the difficult decision to remove him from daycare entirely in hopes of helping him cope with the anxiety.

A 4-Year-Old Should Never Have to Fear Daycare

One of the most painful parts of this case is what changed for the Harris family’s son after the incident. A place that should have felt routine and safe became something he feared, and his parents watched him struggle with emotional outbursts and anxiety tied to the daycare environment.

That is why prohibited punishment and physical mishandling cannot be measured only by whether a bruise fades or a scratch heals. The emotional impact can last much longer, especially for a young child who is still learning whether the adults around him can be trusted to keep him safe.
