Child crying after being left alone at daycareMcKinney, TX – The Button Law Firm has filed a lawsuit on behalf of Texas parents Fernando and Cristina Cossich after their toddler daughter was left alone in a daycare classroom for a long period of time.

What Happened at This Collin County Daycare?

The daycare, Primrose School of Eldorado, is being sued after parents discovered their three-year-old child was left alone in a classroom for a long period of time. The child was only discovered when a separate caregiver walked into the classroom – the child's teacher hadn't even noticed that the three-year-old was missing. The incident happened in October of 2022.

What was even more shocking was that the caregivers who allowed this incident to happen forged the parents' signatures on the incident report. Incident reports are required by the state in case there is any violation of the state's minimum standards. The parents didn't find out about the incident report until they were told by a state investigator.

Unfortunately, a very similar incident happened to a different child just five months later, except in that case, the child was not discovered until their parent arrived at the daycare. The daycare had previously been cited 16 times by the state for several violations, including not following supervision requirements and hiring unqualified workers to watch children.

According to the Texas minimum standards, section §746.1205, daycares are responsible for "Providing the level of supervision necessary to ensure each child's safety and well-being, including physical proximity and auditory or visual awareness of each child's ongoing activity as appropriate" and "Being able to intervene when necessary to ensure each child's safety"

When a caregiver leaves a young child alone and unsupervised in a room, there is potential for serious injuries to happen.
