Daily Mail Features The Button Law Firm's Amended Lawsuit
Our team at The Button Law Firm filed an amended lawsuit against Trinity Lutheran School, which was recently featured by the Daily Mail, bringing national attention to our case involving the emotional and physical abuse of a 4-year-old girl and the preschool's repeated failures to protect her.
The lawsuit describes a preschool classroom where a trusted teacher became the source of a young child's fear. But it also details something just as troubling: months before the incident ever happened, the teacher repeatedly warned the school's director and principal that she was struggling and feared having a breakdown while caring for children.
Months of Warnings Were Ignored
The classroom meltdown did not happen without warning.
As highlighted in the Daily Mail's coverage of our amended lawsuit, text messages included in the petition show the teacher telling Trinity Lutheran School's director and principal that she was struggling with her mental health. In one message, she described having a "meltdown at work" as her "worst nightmare." Other messages reveal that she told the director she had suffered multiple panic attacks and was experiencing suicidal thoughts.
Even after receiving those warnings directly from the teacher, the director and principal continued asking her to work and repeatedly placed her back in charge of preschool children instead of removing her from the classroom or providing the support she requested.
Our amended petition details how those decisions created the conditions that allowed a preventable crisis to unfold inside the classroom.
The Classroom Turned Into a Place of Fear
The breakdown the teacher feared eventually became reality.
The lawsuit describes the teacher screaming at the young girl, ridiculing her in front of classmates, convincing her that her parents did not want her anymore, pretending to call 911, threatening to send her to jail, and telling her she would be locked in a "dungeon."
The emotional abuse quickly became physical abuse. Our amended petition details the teacher shoving the child, dragging her across the classroom, throwing her into a cubby wall, locking her alone inside a dark closet, and striking her while the little girl cried for her mother and father.
As the Daily Mail reported, the child later told forensic interviewers that she had been hit on her face, forearm, and hand.
The Opportunities to Protect Her Kept Passing
The little girl's cries were not hidden behind closed doors.
The evidence outlined in the amended petition shows that multiple adults either walked past the classroom or looked through the classroom door while she cried and screamed. Later that day, the school's director reviewed the surveillance footage showing what had happened.
The lawsuit also describes how the family was not told the full extent of the incident for five days. It further details that hours of surveillance footage from that day are now missing.
Those decisions are a significant reason why this lawsuit extends beyond the conduct of one teacher.
Why Trinity Lutheran School Is Being Held Accountable
Schools have a responsibility to hire qualified staff, respond to warning signs, supervise classrooms, and intervene when children are at risk.
Our lawsuit explains how Trinity Lutheran School failed to meet those responsibilities by continuing to place a struggling teacher in the classroom despite repeated warnings, failing to intervene when the incident unfolded, delaying communication with the family, and failing to preserve important evidence afterward.
As Russell Button explained in comments featured by the Daily Mail, this case shows what can happen when staffing concerns are placed ahead of child safety.
How The Button Law Firm Is Pursuing Accountability
Our team at The Button Law Firm filed this lawsuit to hold Trinity Lutheran School accountable for the decisions that allowed a young child to be emotionally and physically abused while under the school's care.
The Daily Mail also highlighted that the lawsuit seeks accountability for the lasting trauma the child continues to experience, including recurring nightmares, fear of small dark places, and other emotional injuries described in our amended petition.
